Bounced cheque recovery in the UAE

A returned cheque opens more than one route, and they are not equivalent. Which one is actually available to you depends on what kind of cheque it was, what it was given for, and what documentation sits behind it — not on the fact that it bounced.

Why the type of cheque decides everything

Creditors tend to think of a bounced cheque as a single thing. In UAE commercial practice it is at least three, and they behave very differently.

If you are holding a security cheque, the underlying documentation matters more than the cheque does. The cheque is evidence of an arrangement; the contract, invoices and delivery evidence are what establish how much is actually owed under it.

The civil route and the criminal question

Recovery of the money is a civil matter. It is about establishing the debt and compelling payment, and it is the route we work.

Whether a dishonoured cheque also raises questions of a different kind depends on circumstances that have changed considerably in the UAE in recent years, and it is not something a collection agency should be advising on or — as some in this market do — deploying as leverage in a negotiation. Where the question genuinely arises on your file, it is referred to our associate advocates, who are licensed to assess it.

What we will not do

We do not use the threat of criminal consequences as a collection tactic. Beyond the conduct question, it is frequently counter-productive: a debtor who believes they are being threatened stops negotiating and starts taking advice, and the commercial settlement that was available on Monday is gone by Friday.

What to do the week a cheque bounces

  1. Keep the bank return slip. It records the date and the stated reason for return. Do not discard it, and do not rely on being able to obtain a copy later.
  2. Do not re-present repeatedly without a reason to. Re-presenting on a promise that has already failed once achieves little and muddies the record.
  3. Assemble the underlying paperwork. The contract, the invoices, the statement of account and any correspondence in which the debtor acknowledges the balance. This is what determines your position, not the cheque alone.
  4. Get the debtor's response in writing. Anything they say about why it bounced, or when they will pay, is worth having on record.
  5. Act promptly. Cheque matters are time-sensitive in ways ordinary invoice debt is not.

How we handle a cheque claim

The process follows our standard five stages, with the verification stage doing more work than usual: establishing which category the cheque falls into, whether the drawer entity matches the debtor you contracted with, and whether the amount on the cheque is supported by the underlying account.

The formal demand then sets out both the cheque and the debt behind it. In our experience a large share of cheque matters settle here, because a debtor who issued a cheque has already conceded the principle of the debt and knows it.

If the drawer has left the UAE

It complicates recovery but does not automatically end it. What matters is whether the drawer or their company still holds assets or an operating presence in the jurisdiction. That is worth establishing before spending anything on the attempt, and it forms part of the free assessment.

Is a bounced cheque still a crime in the UAE?

The treatment of dishonoured cheques in the UAE has changed materially in recent years and the position depends on the circumstances of the individual cheque. It is not a question a collection agency should answer generically, and we will not pretend otherwise. What we can tell you is whether there is a viable civil recovery route on your documents; anything beyond that is referred to our associate advocates.

The cheque was blank when I received it. Can I still use it?

Blank and undated security cheques are the most heavily contested category, and the debtor will argue the amount does not reflect a settled balance. Your position rests on the underlying documentation rather than the cheque. Send both and we will tell you honestly where you stand.

Should I re-present the cheque?

Only if there is a real reason to believe funds are now available — a specific commitment, not another general promise. Repeated presentation on failed promises achieves little.

The cheque is from a company but signed by the owner personally. Who owes the money?

That depends on how the cheque was drawn and on what the account is. It is exactly the kind of detail that decides a recovery matter, and exactly why the drawer entity is verified before a demand goes out rather than after.

How old is too old for a cheque claim?
